Warranty (Full Text)

The full text of the Limited Warranty as published in your User Manual is reproduced below. Depending on the version of your iBOT® 4000 Mobility System, this information can be found in either Section 11 or Section 13 of your user’s manual.

Limited Warranty

Independence Technology, L.L.C., warrants certain component parts of the iBOT® Mobility System, listed below, to be free from materials and workmanship defects for the time periods noted below. All warranty periods begin on the date the iBOT® Mobility System is delivered to the consumer. Independence Technology’s obligation under this warranty is limited to the repair or replacement, at its sole option, of any defective component part identified and presented within the applicable warranty period. Independence Technology will supply new or rebuilt parts to replace parts that are determined by Independence Technology to be defective during the warranty period. All warranty service must be provided by Independence Technology or an Independence Technology approved and authorized service provider. A loaner system is not available. The warranty periods for the component parts of the iBOT® Mobility System are as follows:

  • Power base, frame and user control panel (except items such as tires, tubes and upholstery)

  • Footrests, lenses, bulbs, calf panel, laterals, and contoured headrest

Six (6) months

  • Battery and battery charger

Six (6) months

Parts that are replaced under warranty are covered for an additional ninety (90) days or until the end of the original warranty, whichever is longer.
OTHER THAN AS SET FORTH HEREIN, THERE ARE NO ADDITIONAL WARRANTIES OR REPRESENTATIONS MADE OF ANY KIND, STATUTORY, EXPRESS OR IMPLIED. INDEPENDENCE TECHNOLOGY SPECIFICALLY MAKES NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNLESS COVERED BY THE WARRANTY HEREIN, THE COSTS OF ALL NECESSARY SERVICING AND REPAIRS WILL BE BORNE BY YOU. THIS WARRANTY IS FURTHER LIMITED BY THE "LIMITATIONS AND CONDITIONS OF LIABILITY" PROVISION HEREIN.

Coverage Limitations; Limitations and Conditions of Liability

This warranty is extended only to the original owner of the iBOT® Mobility System and is not transferable to any subsequent purchaser, transferee, or user.
This warranty shall not apply to any component part if the serial number has been removed or defaced. This warranty will be null and void if the iBOT® Mobility System or any component part thereof is (a) modified or adapted without the prior written approval of Independence Technology, (b) repaired or serviced by someone other than Independence Technology or its authorized representative, or (c) subjected to misuse, negligence, or accident. This warranty will not apply to failures due to normal wear and tear or failure to comply with proper use as outlined in the User’s Manual.

INDEPENDENCE TECHNOLOGY'S SOLE LIABILITY UNDER THIS WARRANTY, WHETHER CAUSED BY THE NEGLIGENCE OF INDEPENDENCE TECHNOLOGY OR OTHERWISE, IS LIMITED TO REPAIR OR REPLACEMENT OF THE COMPONENT PARTS AS DESCRIBED HEREIN. IN NO EVENT SHALL INDEPENDENCE TECHNOLOGY BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, OR OTHER DAMAGES (EXCLUDING DAMAGES FOR PERSONAL INJURY) SUSTAINED BY YOU OR ANY THIRD PARTY, WHETHER CAUSED BY THE NEGLIGENCE OF INDEPENDENCE TECHNOLOGY OR OTHERWISE, INCLUDING WITHOUT LIMITATION PROPERTY DAMAGE, ECONOMIC LOSS OR ANY LOSS OR DAMAGE RESULTING FROM THE INTERRUPTION OR FAILURE IN THE OPERATION OF ANY COMPONENT PART WARRANTED HEREUNDER. HOWEVER, SHOULD ANY IMPLIED WARRANTIES BE FINALLY JUDICIALLY DETERMINED TO EXIST UNDER THE LAWS OF ANY STATE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, UNLESS FINALLY JUDICIALLY DETERMINED OTHERWISE, SUCH WARRANTIES SHALL NOT EXTEND BEYOND THE TIME PERIODS SET FORTH HEREINABOVE NOR PROVIDE RIGHTS ADDITIONAL TO THOSE RIGHTS SPECIFICALLY SET FORTH HEREIN.

Application of Laws

In the U.S., some states do not allow the exclusion of certain warranties or the waiver, limitation or exclusion of liability for damages under certain circumstances. To the extent that any of these limitations are not permitted by applicable law, they will not apply to you. You may also have other rights under applicable law.
